2023 Handbook & Contract Reviews

April 2023 is the perfect time to review your contracts of employment & employee handbooks to ensure that they are always inline with current legislation. Along with the usual legislation, we have highlighted some key recommended clauses for your contracts & handbooks that you may not already have:

Contract of Employment:

 

Right to Work Clause

This clause should detail the requirements of the employee to have the right to work in the UK.

Authorised Healthcare Professionals

Along with GPs, authorised healthcare professionals can also provide employees with ‘fit notes’ and this should be detailed in the contract of employment.

Private Work Clause

This is to ensure your employees do not take on private work whilst working for your company.

Deductions from Pay

This is to clearly outline the situations in which the company would deduct from an employee’s pay and how it would be calculated.

Payment in Lieu

This is to specify that whether the termination is due to resignation or dismissal, the company reserves the right to pay in lieu of notice.

Employee Handbooks:

 

  • Parental Bereavement Leave Policy.
  • Equal Opportunities Policy – are the protected characteristics detailed correctly within this policy. They should be as follows: age, disability, gender reassignment, marriage or civil partnership, pregnancy and maternity, race (including colour, nationality, ethnic and national origin), religion or belief, sex or sexual orientation.
  • Social Media Policy.
  • Bring your own Device Policy.
  • Whistleblowing Policy – this is to specify the charity number that employees can contact.
  • Workplace Cancer Policy.
  • Menopause Policy.
